Accommodation Service Agreement

This agreement is between natural and/or legal person who is to be called Customer in the following articles and OCCIDENTAL ANKARA HOTEL, Tunali Hilmi Caddesi Guniz Sokak No 42 Kavakldere 06700 Ankara Turkey, which is to be called Hotel in the following articles and, Customer and Hotel are to be called Parties in the following articles. The Parties acknowledge the agreement in scope of the following articles, by taking into consideration that the agreement is an official offer and it is including all conditions to provide paid accommodation services and all conditions stated below are obligatory for the Parties and may not be changed by Customer.

1.SUBJECT OF THE AGREEMENT

1.1.In accordance with this agreement, the Hotel is obliged to provide the Hotel Accommodation service upon the request of the Customer (to be called “Service” in the following articles).

1.2.Upon signing of this Agreement (Customer accepts that s/he signed this agreement by making a reservation at the Hotel and / or by booking a service from the Hotel), the Customer confirms that s/he has been informed about the accommodation rules, reservation rules and tariffs.

1.3.Once the Hotel confirmed the request of the Customer, The Parties are deemed to be acknowledged the Agreement.

2.TYPE OF THE ACCOMMODATION RESERVATION

2.1.Reservation of the service may be performed with a request to the e-mail address ([email protected]) by Customer.

2.2.In case of cancellation or any change request, the Customer may send a mail to [email protected] by complying with the matters and fulfilling the conditions specified in the agreement

2.3.If the Customer wants to make changes on the reservations that s/he has the right to cancel/change, Customer or Agent authorised by customer should contact with the Hotel directly by using one of the methods mentioned in article 2.2. before deadline mentioned in reservation offer.

2.4.If the Customer wants to have the right to cancel the reservation without any fees, s/he should book for a revocable reservation.

2.5.If the Customer wishes to make or made any changes on the reservation that s/he booked during a special discount period (early booking etc.) for some reason, with this agreement, the Customer agrees, declares and guarantees that the pricing is going to be made according to the price lists applied during the date of the new reservation. The Customer agrees on that no special discounts will be applied for the reservations that are booked other than the special discount period.

2.6.The Hotel shall respond to the change request to be made by the Customer within the period according to the availability of the Hotel.

2.7.The discount for children because of the age is only applied if the children stay in the same room with their parents (with two adults). The age of the child/children stated by the Customer is to be considered during the check-in. In order to determine the age of the child/children, the attendant of the Hotel may demand the identity cards of the child/children. In this case, the Customer is to present the identity card of the child/children. In case of any difference between the age of the child stated by the Customer and the actual age in identity card, the Customer agrees, declares and guarantees to pay the rate difference after the required changes made on the relevant reservation if there is a difference in terms of rates.

2.8.There should be at least one Customer above 18 years old in the hotel room. Children under the age of 18 may only stay in the Hotel with at least one adult (above 18 years old).

3.MODE OF PAYMENT

3.1.Customer, who will stay in the Hotel, should enter the credit card information to the system through the link shared by the Hotel during the reservation and immediately after, s/he is to be forwarded to the mutual payment page.

3.2.The Hotel acknowledges that the system in which the credit card information is shared is under the protection of a special security system that prevents any appearance or copying of the information in any case. The Hotel also shall not cover the loss and be responsible for the cases such as damages caused by mischievous programmes/programme systems in personal computer of the Customer (such as viruses) and data theft by the third parties resulting from the carelessness of the Customer.

3.3.Customer shall present the credit card or a copy of the forepart of the credit card that s/he used while making the online reservation to the front desk during check-in. The Customer shall be responsible for the damages / loss that is because of not fulfilling his/her responsibilities.

3.4.The invoice shall be given to Customer after Customer benefitted from the service during check-out. If Customer does not take the invoice during check-out, the invoice shall be sent to the address that Customer stated before. In such case as Customer did not state an invoice address, then the invoice shall be sent to the contact address. The Hotel shall not be responsible for being unable to hand the invoice to the Customer because of such situations as stating wrong address, unspecified recipient or not appearing in the address when the cargo arrives.

3.5.Payments that are made on the website of the Hotel is to be in Turkish Lira. The information about other payable currency rates such as Euro, Dollar and British Pound is provided by Central Bank of the Republic of Turkey Head Office.

4.TYPE OF REFUND and CANCELLATIONS

4.1.For the revocable reservations, the total amount shall be refunded without commission, taxes etc. to the Customer in 15 (fifteen) working days following the request of the Customer before the deadline in accordance with the methods specified in the article 2.2.

4.2.In such case as Customer requests for the cancellation after the deadline specified in the stage of reservation, refund of accommodation fee collected by the customer shall not be possible and the Customer accepts and guarantees that s/he made the payment as penalty. In accordance with the agreement, Customer is to pay the VAT if s/he needs to pay the VAT for the penalty and other compensations.

4.3.Refunds and repayments relating to the payments made by credit card shall be made to the credit card or to the debit card that is used for the reservation registration by the Hotel.

4.4.In all refund transactions, the refund shall be made without commission, taxes etc. to Customer by the Hotel.

5.TYPE OF ACCOMMODATION

5.1.Age and identity cards of Customer and accompanies shall be checked during check-in. Customer accepts, declares and guarantees to take any legal responsibility for any situation caused by misinforming. Customer is to defray any expense caused by such situations.

5.2.Customer shall pay all of the extra expenses throughout his/her stay at the Hotel at the moment of check out.

5.3.Customer accepts to enter the room at earliest 14:00 even if s/he comes to the Hotel earlier and to leave the room at latest 12:00 pm even if s/he leaves the Hotel later on and to pay for the extra service after leaving the room.

5.4.Deposit or the total amount of the reservation is to be charged in the course of online booking.

5.5.Pets are not allowed in the Hotel.

5.6.After Customer settles in the Hotel, dispensing the service with refund may only be made if the Hotel is not fulfilling its responsibilities.

6.RESPONSIBILITIES OF THE PARTIES

6.1.The Hotel shall cover the damages by providing additional and / or alternative services to Customer in all cases arising from the reasons other than force majeure after Customer has settled in the reserved room. Acceptance of the additional service or accommodation service by Customer shall mean that the Customer waives the right to request for the refund of the reservation fee which s/he may claim as a compensation and the right to claim any other compensation and litigation action.

6.2.In accordance with this agreement, in the event that the Hotel does not fullfil the service obligations partially or fully, the rules in the relevant laws and regulations shall be applied during the payment of the compensation.

6.3.In the case of poor quality service to Customer, the Customer shall inform the Hotel representative by putting complaint in writing, otherwise the service provided by the Hotel shall be deemed to be perfect and in time.

6.4.In the even that Customer violates any article of the agreement, the Customer agrees and undertakes to cover any damage to the Hotel that is incurred as a result of the violation.

6.5.The Hotel may change the terms and conditions of the accommodation service according to the seasonal conditions and the tourist season.

7.THE OTHER PROVISIONS

7.1.Bad weather conditions, strike/lockout, terror, military action, flood, fire etc. unforeseen circumstances shall be considered as force majeure. In the event of such incidents, the Hotel may not continue to provide service.

7.2.The Hotel reserves the right to change the organisation of any special days such as feast or new year etc. for non-hotel-related reasons.

7.3.In the resolution of the disputes arising in accordance with this agreement, Customer has accepted, declared and undertook that the Divisional Courts are authorised.

7.4.The Hotel reserves the right to indemnify the pecuniary and non-pecuniary costs caused by damage, devastation and/or lost pieces in Customer’s room and in the general areas (in the Hotel).

7.5.Customer should not send any good, object or promotional material on behalf of the Hotel’s employees. The Hotel shall not be responsible for customs procedures in any circumstances.

7.6. According to the law, smoking is forbidden in closed areas of the Hotel. These prohibitions shall be determined within the scope of laws. Therefore, the use of all kinds of cigarettes or tobacco products in the Hotel is not allowed except for the guest rooms specified.

7.7.This agreement shall come into operation with the reservation number given by the Hotel after Customer makes the reservation and payment, and shall end after check-out.
